Reseller Account termination advice

Recently I purchased a reseller account to whom i will not state as of yet as the outcome has not been 100% settled. I have 6 customers that I provide hosting to My Account was terminated Sunday, As the reason was email spam. Which was all I was told I then called this hosting company to try and figure out what domain was sending the email spam to, when the spam was sent I talked to a support representitive (in which i think there is only 1 ) I asked her what domain had been spamming emails, she had told me a domain cedarvalleyweb.com which i do not host, she had also stated to me that my account was terminated In november which is not true. as it was terminated Sunday Jan 23rd. The nameservers of cedarvalleyweb do not point to my nameservers. She had then told me she had called the number that was in my billing contact info. My number had changed a while back which i did not notify the hosting company (which is my fault) but they did have my contact email as to which i never received any emails regarding the issue ( if i would have been notified of the email spamming I would have terminated that users account) Since they could not contact via phone they had then terminated my account terminating all of my 6 customers (which dont seem like a lot but 2 of the accounts are ecommerce websites) so now i am in the process of explaining the situation but they are upset. I know that in the TOS that email spamming was not tolerated and I agree with that 110% as i dont like email spammers also. But the fact taht the email that the domain was from I did no host and if i did i can assure you that they would not/did not spam anyone (as to alot of email spammers use other emails * spoofing * ) Am i in the wrong to be upset about this situation? as they tell me that none of the files can be recovered (which is false since they do backup ) and the 100's of products that my users inputted into the database of the ecommerce site. and orders etc. Can i legally take action if they do not provide proof of the matter (as I was never told anything that had been true via support) what action should i take? I know if i do recover the files and database info i will not host with them and not recommend them to anyone.) Any commensts/help would greatly be appreicated

pretty bad they sound confused... we give 1 warning about spam then turn off the acct. BUT we would never delete files to anyones domain thats in the reseller acct.I am ot sure about the legalities of this (whew I bet your in hot water with those customers.) #1. I would always keep a backup on MY harddrive of anysite or at least have an off site (and out of your providers reach) backup if I was a reseller. sorry for your troubles

Indeed, I do however have a copy of the files of the sites.. what concerns me is the database information which is vital for one of my customers as he has spent alot of hours inserting his products which I know it would be his responsibility to backup and mine so I can understand that completely, but im hoping this resolves in a professional matter and i get some sort of backup of the database even if it's half the products. It's been 10 hours and i have yet to hear from them, and it worries me. I think i have stumped them with the fact that the domain in question was not hosted by me and they don't know how to respond.. But they seemed professional at the time i was looking for a reseller and did resarch here.. i found a complaint but 1 is acceptable as it is hard to satisfy everyone. i am going to announce the hosting company soon so noone else goes through with what I am going through and maybe announciung them will prompt them to find a solution for me.. as i know they are regulars here.. I think you have a reason to be upset. I know I would be upset if all my data was gone and I was not even given evidence of the problem/issue. And even if your client did send spam, it should not result in your entire account being terminated/deleted. Of course if you seem to have multiple spammers sign up regularly, that might be different. But according to you, you have only 6 accounts and 1 spammed. Certainly there would be room for some sort of communication. I would continue to try and contact them to see if you can recover your data!

If the domain doesn't even point to you, why should they even suspend you?

Exactly, that what i was trying to figure out ( the domain not pointing to me) I told the lady that i did a whois and the ns's didnt point to my ns's. And she said that she dont have enough information and that she was assigning me to an administrator... which is another lady, I asked to talk to them when i was on the phone with her and she wouldnt let me I also asked to talk to a tech and again she wouldnt let me and kept repeating that I was going to be assigned to another person. which really ticked me off like i was talkin to a call center. Anyways the hosting company I am having issues with is surfspeedy.com hopefully I can get some answers... If i am provided with the information i need and I am indeed in the wrong then shame on me.. but i mean I've been with them for a while now and have not had any problems until now and I hate to give anyone a bad rep for something that might be my fault but it shouldnt be to hard to give me the details i need.

if you were/are a reseller provider and you had an issue with a reseller and you tried contacting them by phone but the phone was no longer valid.. would you not try to contact via email?

Well, I'll usually contact them via email first But really, they should get the thing sorted out quickly and I feel that their support isn't doing their job well...

Yah i think it's a 2 man team there.. since i always seem to talk to the same person. Who knows... but they should have resonded by now.. and now my one client is threatning to take me to court over lost profit =\ which i can understand him being upset. so i am going to contact a lawyer tomorrow and see what can be done. rediculous.... a nice site makes them look "good" but really are they?"
